November Conference on Bair Hugger Hip and Knee Infection Lawsuits

A conference has been scheduled to updated the Bair Hugger MDL status in November. There is a Hip and Knee Infection MDL that was created in Minnesota. The Bair Hugger MDL currently has over 800 Hip and Knee Infection lawsuits in the MDL. These Knee Infection and Hip Infection lawsuits claim that 3M Company and Arizant Healthcare failed to warn patients and doctors of the risk of infection due to Bair Hugger blankets.

Over 30 New Essure Lawsuits Filed

Over 30 new Essure lawsuits have been filed in St. Louis against Bayer by women who claim they have been injured by the birth control device Essure. This next wave of Essure lawsuits were filed in the Circuit Court of St. Louis on March 17th. There were a series of Essure lawsuits that were dismissed last month after the judge stated they could not move forward due to the FDA giving Bayer Pre Market Approval of Essure. In a statement Bayer said the following:

“We have sound defenses including federal preemption. The design, manufacturing method, warnings and instructions for use for Essure were approved by FDA under the agency’s pre-market approval (PMA) authority, which subjected Essure to the highest level of scrutiny that exists in the federal regulatory system.  FDA’s recent actions on Essure confirm that this lawsuit is preempted."

A congressman has introduced the E-Free Act, which if passed, would eliminate Essure and also remove it's pre-market approval which would presumably allow Essure Lawsuits to move forward.

Volkswagen is offering a $500 Visa Gift Card and $500 Volkswagen Dealership Card to individuals who own certain types of Volkswagon. Accepting this Volkswagon credit, does not waive your right to file a Volkswagen Diminished Value claim in the future. The cars that qualify for this Volkswagen credit include:

    VW Jetta TDI (Model Years 2009 – 2014)
    VW Jetta SportWagen TDI (Model Years 2009-2014)
    VW Golf TDI (Model Years 2010-2014)

Essure Fight Not Over

Four woman in California have withdrawn their Essure lawsuit claims, after a federal judge ruled that their state law claims were preempted by Federal law. The Essure lawsuit move ensures that these 4 women can amend their Essure lawsuit and file later.

The FDA is expected to release it's study on Essure and dangerous side effect by the end of Feb of this year. The E-Free Act is still in play which remove Preemptive status for Essure and allow the Essure lawsuits to move forward. The Facebook group the "E Sisters" were again in Washington trying to garner support for the E-Free Act. We are still investigating lawsuits regarding Essure, should the preemptive status be removed.
